Abuja High Court restrains former Inspector-General Mike Okiro and a real estate company from further trespass on property belonging to a retired Navy officer.

Apparently, the company, Al Net. Nig Ltd illegally acquired the plot of land and illegally sold to buyers, including Mr. Okiro.

Okiro and Commander Jonathan Anioke (rtd) disputed ownership of Plot 1870, Cadastral Zone 07-07 at Lugbe East Extension, Abuja FCT.

Anioke subsequently sued for possession from Al Net and other it sold to. He said Al Net and Mr. Okiro moved equipment to the site to commence construction.

In court papers, he said policemen were equally deployed to the  plot to prevent his access to the property.

Anioke told the court that he was forced to seek redress since he legitimately acquired the property that Al Net and Mr. Okiro were claiming as theirs.

Justice Hamza Muazu ruled that papers presented by Mr. Anioke were genuine and demonstrated true ownership of the property.

Anioke is the “rightful and beneficial owner of the plot,” he said, and should go ahead to seek a certificate of occupancy for the plot.

He also granted the motion for Mr. Anioke to immediately take possession “without further interference from third parties.”

In his final ruling, he ordered Al Net and Mr. Okiro to vacate the property, remove policemen deployed to the site, and pay the navy officer damages assessed at N1.00 million for the trespass.

The judge also ordered them to desist from “trespassing, encroaching, interfering” and making further ownership claims over the plot.
