Chijioke Edeoga, Labour Party governorship candidate for Enugu wins on the appeal to set aside a high court dismissal of the party primaries
In Abuja today 6 January 2023, a federal appeal court gave a breather to Chijioke Edeoga, the Labour Party candidate by affirming him as authentic candidate of his party for Enugu State governorship election.
The election holds in March, two months away.
The Labour Party appealed the judgement of a federal high court which voided the primaries held by the party that produced the candidate. The decision was based on a plea by a disfavored applicant, Capt. Everest Nnaji who complained that the party did not invite him to the primaries. He produced evidence to show that he is a member of the party, paid for and obtained both expression of interest and nomination forms.
Although the lower court allowed the plea, the appeal court today said the exercise at this court was a waste of time.
The appeal court ruled that since Nnaji did not participate in the primaries that produced Edeoga, he has no locus standi to challenge its outcome.
It also ruled that the issue of locus standi was enough to not delve into the matter that the lower court considered in voiding the outcome of the primaries.
Alexander Obodo, a senior advocate, represented the Labour Party in the appeal.
