Barrister and activist CD Ogbe has fought many battles to make his beloved Enugu a better place to live and do business. Unsung and unappreciated, this vibrant advocate has done more for residents of the Coal City than a plethora of Council Chair that routinely pass through Enugu North, South and East LGAs


It is axiomatic that the primary role of government is to ensure the overall good of a vast majority of the citizenry. It behooves right thinking members of the society to ensure that any government in power does not abdicate that responsibility of ensuring that the wellbeing of the masses is accorded attention. This socio-political ideology as afore-described, which has garnered global acceptance in virtually all democracies, has been the factor fuelling my activities of checkmating the leadership anomalies going on in government circles in Enugu State of Nigeria.

Those at the corridors of power may not be opportune to feel the pulse of the governed on some occasions, because of the overbearing influence of praise singers who surround them. It serves no utilitarian purpose complaining over how bad the polity has become, without coming in drawing the attention of those serving to some anomalies going on in our society and having their actions challenged within the ambit of the law when need be.

DELAY IN CONDUCTING ENUGU LG ELECTIONS

When it was obvious that the Enugu State Independent Electoral Commission (ENSIEC) was not willing to conduct local government council election for Enugu State in the year 2019 within the period of time envisaged by the Local Government Law of Enugu State, my political party the African Peoples Alliance (APA), at the direction of the national leadership of the party, and sequel to my prodding in that regard, initiated an action at the High Court of Enugu State in the case known as African Peoples Alliance Vs. Enugu State Independent Electoral Commission & Ors E/915/2019, in which the APA prayed the Court to compel ESNIEC to conduct local government election in Enugu State.

Though the matter is still sub-judice, however, the ESNIEC alongside the Government of Enugu State, not quite long after the suit was initiated, published the timetable for the conduct of 2020 local government council election in Enugu State.

POOR WORK ENVIRONMENT FOR ENUGU JUDGES

Prior to the year 2015, lawyers and litigants who had legal business to conduct at the Enugu Judicial Division of the High Court of Enugu State, encountered herculean challenges in having their cases heard, owing to the absence of a functional standby electricity generator installed in the premises of the High Court. I approached the High Court of Enugu State in the case known as the case of Mr Chukwunonso Daniel Ogbe v. Governor Enugu State & Anor with number E/316M/2015, to assert that the absence of a functional generator set installed in the premises of the High Court of Enugu State to assist in ensuring a speedy trial of cases, violated the right of litigants facing criminal trial to be tried within a reasonable time as envisaged by article 7 of the African Charter.

Admittedly, the suit did not see the light of the day, but my Lord, the now Hon. Chief Judge of Enugu State, the Hon. Justice N.P. Emehelu in her ruling in the concerned suit, held that it is desirable that a generator set be installed in the premises of the Enugu Judicial Division of the High Court of Enugu State. Not quite long after judgment was delivered in the concerned case, the Government of Enugu State installed a functional generator set in the premises of the High Court of Enugu State.

THE EEDC METER SWAP POLICY

Of late, the consumers of electricity in Enugu State cried bitterly over the policy of the Enugu Electricity Distribution Plc (EEDC) in phasing out the use of standalone prepaid meters in Enugu State and other States in the South-east geopolitical zone under controversial circumstances. Help failed to come from statutory bodies saddled with the responsibility of checkmating the excesses of EEDC. I took up the issue in the case of Mr Chukwunonso Daniel Ogbe v. Enugu Electricity Distribution Plc & Ors E/01/2020, for the Court to appraise whether the actions of EEDC in phasing out the use of standalone energy prepaid meters amounts to the violation of the fundamental right of the consumers of electricity not to be exploited and not to be subjected to inhuman treatment, among other reliefs. The matter is still sub-judice and we await what will be the pronouncement of the Court of law on that issue.

ESUT DEVELOPMENT LEVY SCANDAL

The management of Enugu State University of Science and Technology (ESUT) in the year 2019 introduced a policy in which the undergraduate students of ESUT are to pay the sum of N 50, 000.00 as development levy. At the direction of my political party the APA, the APA filed an action at the High Court of Enugu State in the case known as the case of African Peoples Alliance Vs. Enugu State University of Science and Technology & Anor HAGB/60M/2019 for the Court to determine whether the imposition of development levy by ESUT on the undergraduate students of the ESUT does not violate their right to education as guaranteed under article 17 (1) of the African Charter. The matter is still sub-judice and we await the pronouncement of the Court on the questions and reliefs sought to be addressed in the suit.

STATE OF ENUGU ROADS

On the 12th day of December 2019, I championed the online campaign entitled Bring Back Our Beautiful Enugu State Roads on the Facebook Page of the Enugu State Chapter of APA, being @apaenugustatechapter. The online protest was carried out because of the deplorable state of many vital roads in Enugu State. The campaign is yielding the desired result as the 2020 Appropriation Law of Enugu State promises to tackle the prevalence of bad roads in Enugu State.

CONCLUDING THOUGHTS

It serves no utilitarian purpose complaining over how bad the polity has become, without coming in drawing the attention of those serving to some anomalies going on in our society and having their actions challenged within the ambit of the law when need be. The duty of making Enugu State better is that which should be shouldered by the leaders and the governed alike.
